People responsible
Naresh Ashok, Chief Executive Officer and Key Individual, is responsible for overseeing our licensed activities. Our representatives are individually approved to give advice and must pass the regulatory examinations and meet fit-and-proper requirements. We will tell you who is advising you and their credentials on request.
Conflicts of interest
A conflict of interest is a situation where our interests, or those of our people or partners, could get in the way of giving you fair advice. We take these seriously. Our policy, in summary:
- We identify them. We look for conflicts when we take on a customer, when we recommend a product and when we receive anything of value from a product provider.
- We avoid or manage them. Where we cannot avoid a conflict, we manage it, for example by having another person review the advice or by stepping back.
- We disclose them. We tell you about a conflict before we advise you.
- Gifts and incentives. Staff may not accept or give gifts, fees or benefits that could influence advice. Anything allowed under the law is declared and recorded in a register.
- Financial interests. We do not hold any ownership or financial interest in a product provider above the legal thresholds.
- Product providers. We work with a number of insurers and product providers. A list of those we have agreements with is available on request.
- Review. The Key Individual and compliance officer review the conflicts register at least yearly. Staff must declare conflicts and receive training.
The full conflict of interest management policy is available on request from info@brawne.co.za.
How we are paid
We are paid by commission from product providers, by fees you agree to, or both. Before you sign, we tell you in writing how much we will earn from the transaction and what it is for. The law limits commission on some products.
Treating customers fairly
We follow the six Treating Customers Fairly outcomes in everything we do:
- Customers can be confident they are dealing with a firm where fair treatment is central to its culture.
- Products and services are designed to meet the needs of identified customer groups.
- Customers are given clear information before, during and after the point of sale.
- Advice is suitable and takes account of the customer’s circumstances.
- Products perform as customers have been led to expect, and service is of an acceptable standard.
- Customers do not face unreasonable barriers to change product, switch provider, submit a claim or make a complaint.
Identification and records
The Financial Intelligence Centre Act, 2001 requires us to identify and verify the identity of customers and, where relevant, those who own or control them, and to keep records. We will ask for identity and address documents when you become a customer. We keep records for at least five years and protect them under POPIA. See our privacy notice.
Our insurance
The Financial Advisory and Intermediary Services Act requires us to hold professional indemnity cover and fidelity cover. We hold both. Details are available on request.
